Eric is focused on rigorous factual investigation, gaining a deep understanding of the clients’ business, and aligning the facts, law and advocacy to seek the best answer and outcome for clients. Eric is known for early case evaluation and resolution strategies, strategic insight, and striving for the highest quality communications with clients, the Court and adversaries.

As a highly experienced litigator, Eric has expertise in major commercial disputes, including complex contractual, technology, telecommunications, and trans-border matters, and claims relating to misleading conduct, breach of fiduciary duty and misuse of confidential information.

He is admitted to practice in Australia and in New York State, and has conducted and advised on proceedings in Australia, the USA and the Pacific region.

Eric joined Hamilton Locke from his litigation and dispute resolution practice, EMB Legal. He previously held the position of Chief Litigation Counsel at Telstra, where he was responsible for the conduct of over $3.0 billion in major case litigation.  Prior to his position with Telstra, Eric was a lawyer at the premier US litigation firm, Williams & Connolly, based in Washington DC.

SELECTED REPRESENTATIONS

  • Represented an Australian health care provider in disputes relating to technology supply and joint venture contracts.
  • Acted for Telstra in disputes relating to major IT supply contracts, and a dispute for recovery of a major joint venture investment.
  • Advised a major mining equipment supplier on a range of complex contractual disputes.
  • Acted as lead counsel for Defendants in US Federal Court proceedings between competitors involving trademark infringement, false advertising and confidential information claims, achieving dismissal of most claims and settlement of the remaining claims.
  • Represented plaintiff in claims in Australia against a major Japanese company relating to misuse of confidential information, and breach of contract.
  • Represented US-based retailer in claims brought in Australia by a listed Australian supplier, resulting in settlement of misleading conduct, breach of contract and negligence claims.
  • Advised Australian investors in a US entity on US Federal Court litigation relating to e-commerce trademark claims.
